Terms of Service

These Terms of Service (“Terms”) govern your use of Operiko’s software products, including OperikoZEN, OperikoInsure, and OperikoChart (the “Services”). Operiko is headquartered in Montreal, Quebec, and provides workflow and documentation tools to professional users across Canada. These Terms apply only to business users (e.g., practitioners, advisors, operators). Consumers who book appointments through OperikoZEN interact with the business using ZEN, not Operiko.

To use the Services, you must:

• be at least 18 years old;
• be a business user or professional operator;
• provide accurate registration information;
• agree to these Terms.

Operiko offers three independent products:

• OperikoZEN — booking & workflow
• OperikoInsure — insurance workflow automation
• OperikoChart — clinical documentation automation

Each product:

• has its own subscription;
• has its own pricing;
• has its own user base;
• does not share accounts or data with other Operiko products.

Subscribing to one product does not grant access to another.

You must keep your login credentials confidential. You are responsible for all activity under your account. We may require password resets if suspicious activity is detected.

Plans may include monthly, annual, or professional subscriptions. Pricing may change with notice. Subscriptions renew automatically unless cancelled. Refund rules vary by plan and are displayed at purchase.

Either party may terminate an account with notice. Upon termination:

• access ends;
• we may delete your account and associated data;
• you must export any needed data before termination.

ZEN users may request temporary access for data export for up to 90 days.

You retain ownership of all data you upload.

7.1 OperikoZEN

ZEN stores limited customer information:

• name (real or alias);
• email;
• phone number;
• booking metadata.

Stored securely in Canada.

7.2 OperikoInsure & OperikoChart

Operiko does not store or retain:

• insurance client data;
• medical records;
• clinical notes;
• sensitive personal information.

All such data remains fully under your control and stored on your own systems (e.g., local storage, Google Drive). Operiko processes such data only temporarily in memory to generate outputs. No copies are retained.

For businesses using OperikoZEN, Operiko processes personal information belonging to the business’s customers solely on behalf of the business and according to the business’s instructions. Operiko:

• processes data only to provide the Service;
• does not use customer data for its own purposes;
• applies reasonable security measures;
• deletes data upon account termination or upon request from the business;
• notifies the business of privacy incidents when required.

8.1 Infrastructure Providers

Operiko does not share OperikoZEN customer booking data with AI vendors or any external processors beyond the infrastructure providers necessary to operate the Service. Customer booking data (name, email, phone, and appointment details) is stored and processed within Operiko’s hosting environment located in Canada, using a Canadian-region Oracle Cloud infrastructure provider.

Operiko may offer optional AI-powered features.

9.1 Operiko’s Commitments

• Operiko does not use your data to train its own models;
• Operiko does not sell your data;
• Operiko does not retain regulated data processed by AI.

9.2 Third-Party AI Vendors

AI features may send data to external AI providers. These providers may:

• temporarily retain data;
• process data outside Quebec;
• apply their own retention or training policies.

Operiko cannot guarantee third-party practices. You must review the privacy policies of any AI vendor used within the Service.

9.3 Additional Consent for Regulated Data

AI processing of regulated data (insurance or medical information) requires explicit opt-in. Opt-in mechanisms are provided within the relevant product interface.

Operiko provides workflow automation, AI-assisted drafting, and document-generation tools. All outputs generated through Operiko — including any text, documents, suggestions, or automated content — are produced solely based on the information, templates, and instructions provided by the user. Users are fully responsible for reviewing, verifying, and approving all generated content before use. Operiko does not guarantee the accuracy, completeness, regulatory compliance, or professional suitability of any generated content and assumes no liability for decisions, actions, or outcomes based on such content. AI-generated outputs may contain errors or omissions. Users must independently verify all information before relying on it.

You may not:

• use the Services unlawfully;
• attempt unauthorized access;
• interfere with system integrity;
• reverse-engineer the Services;
• upload malicious code.

We may modify or discontinue features at any time.

To the extent permitted by law:

• Operiko is not liable for indirect or consequential damages;
• total liability is limited to the amount paid in the previous billing period;
• you are responsible for verifying outputs generated by AI or automation tools, as further described in Section 10 (AI Output Disclaimer).

The Services are provided “as is” without warranties of any kind.

These Terms are governed by the laws of Quebec, Canada. Disputes will be resolved in Quebec courts.

Operiko provides its Terms of Service and Privacy Policy in both English and French. Business users may choose the language version they prefer. Both language versions have equal legal force. If any clarification is required regarding interpretation, the parties agree to resolve it based on the chosen language version at the time of acceptance.

These Terms and the Privacy Policy constitute the entire agreement.
